Kelly Shivery Publishes “False Claims Act 101” in the Quarterly Journal of NALA

Kelly Shivery, an Advanced Certified Paralegal at Whistleblower Law Collaborative, authored an article published in the September 2024 issue of Facts & Findings, the Quarterly Journal of NALA. Her piece, “False Claims Act 101,” offers a comprehensive overview of the False Claims Act (FCA), covering its origins, the components of a qui tam case, and key elements for a successful claim.

In “False Claims Act 101,” Kelly explains what types of conduct violates the FCA and the important role that whistleblowers can play in fraud enforcement.  She examines the landmark decisions in Escobar and SuperValu, which significantly altered the FCA legal landscape.  The article also highlights the financial impact of qui tam suits, noting that government recoveries exceeded $2.3 billion in fiscal year 2023, with whistleblowers receiving $349 million in rewards.  This introductory guide serves as a valuable resource, increasing awareness of the FCA among legal professionals.
